SPONSOR: CBC Federal Credit Union, 2151 E Gonzales Rd, Oxnard, CA 93036. (“Sponsor” or CBC) is the sponsor of the Sweepstakes.

SWEEPSTAKES PERIOD:  Sweepstakes begins on Monday April 22, 2024 at 8 AM PT and ends on Sunday June 23, 2024 at 11:59 PM PT. (“Sweepstakes Period”).

CONSUMER DISCLOSURE:  One (1) potential winner of the sweepstakes will be selected by a random drawing every Friday of the Sweepstakes period starting on or about May 3rd  from all eligible entries received. Subject to verification of eligibility and compliance with the terms of these Official Rules, the potential winners will be declared the official winner (each, a “Winner”) of the Sweepstakes. The decisions of Sponsor are final and binding on all matters relating to the Sweepstakes. Odds of winning depend on the total number of eligible entries received.

PRIZE:  One (1) Winner will be awarded the amount of the qualifying credit transaction of $100 each week. One (1) Grand Prize Winner will be awarded $550. The Winners will each receive the prize deposited in their CBC savings account within five (5) business days of acceptance.

(1 Weekly Drawing, 9 total). The total Approximate Retail Value (“ARV”) of all these 9 prizes is $900.

(1 Grand Prize Drawing, 1 total). The total Approximate Retail Value (“ARV”) of 1 grand prize is $550.

The Total ARV of all prizes is $1,450.

ODDS OF WINNING: The actual odds of winning depend on the number of eligible entries received.

HOW TO ENTER:  To enter in the Sweepstakes, simply use your CBC credit card to make purchases totaling $50 or more during the Sweepstakes Period. Limit one (1) entry per person. Each qualifying purchase of $50 or more made during the Sweepstakes Period will earn you one (1) entry into the Sweepstakes.

ALTERNATIVE METHOD OF ENTRY:  All other eligible persons may enter by legibly printing their name, address (including zip code), telephone number (including area code), and e-mail address (optional) on a 3” x 5” card and mailing it in a #10 stamped envelope to: CBC Federal Credit Union, Attn: Card Services/Shop and Score Sweepstakes, 2151 E Gonzales Rd, Oxnard, CA 93036.

Limit one mailed-in entry per member. If a write-in entry form or card is drawn, but judges are unable to determine the winner because of illegible writing, that entry form or card will be disqualified. No copies, mechanical reproductions, or metered mail accepted. Mail-in entries must be received by the Thursday before each weekly drawing. Proof of mailing does not constitute proof of delivery. The Sponsor is not responsible for lost, late, stolen, incomplete, inaccurate, undelivered, delayed, misdirected, damaged, postage-due, or illegible entries or mail. Once submitted, entries become the sole property of the Sponsor and will not be acknowledged or returned.

OPT-OUT PROCESS: Entrants who use their credit card during the Sweepstakes Period, send an email to [email protected] with your opt out request by April 22, 2024. Include “Opt-Out Request” in the subject line and the name and email associated with your account in your email request. You will be opted out of the prize drawing by sending one email request.

ELIGIBILITY:  Employees, vendors, Board Members, volunteers and consultants of CBC, and members of their immediate families (e.g., parents, children, siblings, spouse, son-in-law, daughter-in-law) and members of their households (whether related or not) are not eligible to participate in the Sweepstakes. To qualify for the Sweepstakes, all entrants must be a U.S. legal resident 18 years of age or older and a CBC member in good standing with a qualifying credit card account. Previously selected Winners are ineligible for the remainder of the Sweepstakes Period. Winners are limited to one (1) Sweepstakes or Contest prize per household every 90 calendar days. By entering this Sweepstakes, entrants accept and agree to be bound by these Official Rules and the decisions of the Sponsor. Sweepstakes void where prohibited by law. Entries by ineligible persons, fraudulent, or created in error will be disqualified and an alternate entry will be selected.

SELECTION OF WINNER(S):  Potential winners will be selected in a random drawing by a CBC representative on or about the Winner Selection Date from among all eligible entries received during the Sweepstakes period. For this Sweepstakes, Sponsor will randomly select one (1) winner each week.

All drawings will be held at CBC’s Headquarters located at 2151 E Gonzales Rd, Oxnard, CA 93036. In the event the prize drawing falls on a federal holiday, the prize drawing will be held on the next business day. The winners need not to be present and will be notified through the appropriate notification process below.

NOTIFICATION: Each potential Winner will be notified at the e-mail address, postal address, and/or telephone number (in the sole discretion of Sponsor) provided at the time of entry (the “Prize Notification”). CBC will make its best reasonable effort to contact all winners. If any potential Prize Winner does not respond to Prize Notification within 2 days of the first notification attempt, or declines the Prize for any reason, a disqualification will result, the Prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential Winner may be selected from among all remaining eligible entries. Sponsor may successively attempt to contact up to two (2) potential Prize Winners in accordance with these rules, and if there is still no conformed winner after such attempts have been made, if any, the applicable prize may go unawarded. Each potential Winner may be required to submit his/her valid Social Security number and/or other identification to Sponsor to claim Prize. Failure to submit any identification required by Sponsor within the specified time period may result in disqualification and Prize forfeiture and, at Sponsors sole discretion and time permitting, may cause an alternate potential winner to be randomly selected from among all remaining eligible entries.

WINNER VERIFICATION: Potential winners are subject to verification of eligibility and compliance with these Official Rules. Each potential winner may be required to execute an Affidavit of Eligibility and Liability Publicity Release. Failure to return signed Affidavit of Eligibility and Liability Publicity Release within two (2) days of prize notification will result in forfeiture of prize.

WINNERS’ LIST: For a list of Winners’ names, mail a request and self-addressed stamped envelope to be received within three (3) months of the last day of the Entry Period to: CBC Federal Credit Union, Attn: Card Services/Shop and Score Sweepstakes, 2151 E Gonzales Rd, Oxnard, CA 93036.

LIABILITY: CBC is not responsible for any loss that may occur in connection with the Sweepstakes. Entrant agrees to hold CBC harmless from any liability arising from participation in the Sweepstakes or the acceptance, receipt, possession, or misuse of the prize. CBC and each of its officers, directors, employees, members, and representatives and agents are not responsible for any negligence, claims, liability, injury, property loss, or other damages of entrants and/or winners arising from, or in connection with, acceptance, receipt, possession, or use/misuse of prizes awarded or participation in this Sweepstakes. CBC is not responsible for any incorrect or inaccurate information, whether caused by tampering, hacking, or by any of the equipment or programming associated with the Sweepstakes. Prize cannot be substituted, converted to cash, assigned, or transferred by winners. TAX REPORTING: CBC will report all prize winnings to the appropriate state and federal agencies as required by applicable law and will issue an IRS Form 1099-MISC for each winner, when required. ALL TAXES, FEES, SURCHARGES OR LIABILITIES ON OR RELATING TO PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. PAYMENT OF ANY FEDERAL, STATE, OR LOCAL TAXES WILL BE THE OBLIGATION OF THE WINNER AND ANY COSTS NOT SPECIFICALLY IDENTIFIED HEREIN ARE THE RESPONSIBILITY OF THE PRIZE WINNER.

PUBLICITY AUTHORIZATION:  By entering this Promotion, each entrant gives his/her express permission to be contacted by Sponsor by telephone, e-mail and/or postal mail for Promotion purposes. The Winner, by acceptance of the Prize, grants to Sponsor, and each of its designees the right to publicize the Winners name, address (city and state/territory of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.

CHOICE OF LAW:  All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrant and the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA, without regard to choice of law rules.

NOTICE OF BINDING ARBITRATION AGREEMENT:   In this section, “you” refers to Entrant. You and CBC agree to attempt to informally settle any disputes arising out of or connected with this Sweepstakes or any prizes awarded. If that cannot be done, you and CBC agree that upon the election of either you or CBC any claim or dispute arising out of or connected with this Sweepstakes will be resolved by BINDING ARBITRATION administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and Mediation Procedures and Supplementary Procedures for Consumer-Related Disputes (“Rules”). As a result, you will GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under these Official Rules (EXCEPT FOR CLAIMS BROUGHT INDIVIDUALLY WITHIN SMALL CLAIMS COURT JURISDICTION, SO LONG AS THE CLAIM REMAINS IN SMALL CLAIMS COURT). You acknowledge that by agreeing to BINDING ARBITRATION you understand and agree to the following terms:

(a) Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury. You understand and agree that YOU ARE WAIVING THE RIGHT TO A TRIAL BY JURY.

(b) Arbitration proceedings provide you a FAIR HEARING, BUT the arbitration procedures are SIMPLER AND MORE LIMITED THAN RULES APPLICABLE IN COURT.

(c) Any claims and defenses that can be asserted in court can be asserted through arbitration. The arbitrator shall be entitled to award the same remedies that a court can award, including PUBLIC INJUNCTIVE RELIEF to the extent available under the CALIFORNIA UNFAIR COMPETITION LAW AND CONSUMER LEGAL REMEDIES ACT. Discovery shall be available for non-privileged information to the fullest extent permitted under the Rules. The arbitrator’s award can be entered as a judgment in court.

(d) Arbitration decisions are as enforceable as any court order and are subject to VERY LIMITED REVIEW BY A COURT.

(e) ARBITRATORS can award the same REMEDIES including DAMAGES that a COURT can award.

(f) Any ARBITRATION under these Official Rules WILL BE ON AN INDIVIDUAL BASIS. You understand and agree that YOU ARE WAIVING THE RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER IN A CLASS ACTION.

(g) The PLACE OF ARBITRATION shall be in the federal district WHERE YOU RESIDE.

(h) This NOTICE OF BINDING ARBITRATION AGREEMENT shall be interpreted and enforced in accordance with the Federal Arbitration Act set forth in Title 9 of the U.S. Code to the fullest extent possible, notwithstanding any state law to the contrary, regardless of the origin or nature of the claims at issue.

(i) If YOU PREVAIL on the merits of your claim in arbitration, CBC WILL PAY YOUR ATTORNEYS’ FEES. You will NOT be required to pay CBC’S ATTORNEYS’ FEES IF CBC PREVAILS.
